Legal Procedure
In the first step of the qualification phase, our client and challenge giver want to remain anonymous.
But if you qualify for the elaboration phase, you will get to know the TIER-1 car manufacturer personally.
The legal process within the Challenge is as follows:
If you don’t belong to the winners of our challenge no rights will be transferred or granted.
Also Foreground IP, i.e. IP that already exists and is brought into the Challenge by participants, is not affected and will not be transferred or granted.
The Background IP of the winners, i.e. potential rights that are created during the challenge and in the cooperation with the challenge giver in the elaboration phase, will be exclusively transferred or granted to the challenge giver against payment of the prize money.
Furthermore, at the start of the elaboration phase, an obligatory coordination meeting between the qualified participants and the client will take place. Here a binding agreement on what is to be understood as a Foreground IP needs to take place.
In addition, a different agreement can be reached on the handling of Foreground IP, Background IP and blocking period.
Note: If the parties (Challenge-Giver and participants) cannot agree on a procedure, the Challenge-Giver is entitled to appoint a successor and to exclude the team concerned without compensation.
